Last year’s conference examined the tension between IP and fundamental human rights in selected areas, from access to information to the provision of global public goods, such as a continued flow of downstream research, health and biodiversity. Chairman Marco Ricolfi Turin Law School This year we propose to examine the jurisdictional venues where this tension may emerge in the course of adjudication: before transnational and supernational tribunals, such as the European Court of Human Rights (ECHR), the European Court of Justice and WTO panels, as well as before national courts, from the US Supreme Court to Member States’ Courts. There is not, however, a perfect overlap between the two perspectives. In the more jurisdictional setting of this year’s conference, it will be possible to also look at the interplay between IP protection and concerns for competitive openness as well as at more traditional doctrines, extending the constitutional protection of property to intellectual property.
